If an employer begins
advertising while the Prevailing Wage Request is pending, then the PERM application must be submitted by the expiration date of the Prevailing Wage Determination or by the expiration date of the advertisements, whichever is earlier.
If all advertisements begin after the Prevailing Wage Determination is issued, then the PERM application must be submitted by the expiration date of the advertisements.
Prevailing Wage Requests are currently taking around 6 months to be issued (as of July 2022).
Prevailing Wage Determinations issued between April 2nd and June 30th are valid for 90 days.
This means that Prevailing Wage Requests submitted around November through January are likely to be issued with a validity period of 90 days.
Prevailing Wage Determinations issued after June 30th are valid through June 30th of the following year.
